Terms of Service

1. Who operates Mitra

Mitra ("the Service") is provided at brain-wise.com by Brainwise Solutions, a sole proprietorship, with its address at Aliabad Jhanda, Charminar, Hyderabad, Telangana – 500053, India. "BrainWise" is the brand and product identity used by Brainwise Solutions, and "Mitra by BrainWise" is the name under which the Service is offered to you.

2. What the Service does

Mitra lets a business owner create a "Business Brain" profile, upload a product photo and an offer, and generate a local marketing campaign consisting of AI-generated marketing copy and AI-generated campaign images. Copy and image analysis are generated using Google Gemini models; images are generated using OpenAI's image models. Generated campaigns can be downloaded or shared, including via WhatsApp links. Generation and related actions consume credits, which are granted through paid subscription plans and one-time credit packs.

3. Truth Check

Mitra includes an automated "Truth Check" step intended to flag some categories of potentially unsupported or risky claims in generated campaign copy. Truth Check is a best-effort automated check, not a legal, factual, or regulatory guarantee. It may miss issues or flag things incorrectly. You are solely responsible for reviewing all generated content — including copy, images, offers, and claims — for accuracy, legality, and appropriateness before publishing or distributing it.

4. AI-generated content — limitations

Content generated by Mitra is produced by third-party AI models (Google Gemini and OpenAI). AI-generated text and images can be inaccurate, can misstate facts about your business or offer, and can occasionally resemble existing third-party content, trademarks, or copyrighted material without either party intending it. You are responsible for verifying generated content and for having the rights needed to use it before you publish it. Your use of AI-generated output is also subject to the applicable third-party AI providers' own usage policies.

5. Your content

You retain ownership of the photos, logos, business information, and other content you upload to Mitra ("your content"). You grant Mitra a limited license to process your content — including sending it to the third-party AI providers described above — solely to operate the Service and generate your campaigns. You represent that you have the necessary rights to any content you upload and that it does not infringe any third party's rights.

6. Your responsibilities

• Provide accurate information about your business and offers.
• Keep your account credentials secure and not share your account with others.
• Do not use the Service for unlawful, fraudulent, or impersonating purposes.
• Do not upload content you do not have the rights to use, or content that infringes third-party trademarks or copyrights.
• Do not attempt to circumvent credit limits, rate limits, or security controls.
• Review all AI-generated output before publishing or relying on it.

7. Credits, subscriptions, and payments

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment details are entered with Paddle; Mitra does not receive or store your card or bank details. Paid plans renew automatically at the end of the selected billing interval (monthly or yearly) until you cancel. Credits are granted when a payment is confirmed and are consumed as you generate campaign content. Plan credits are valid through the calendar month in which they apply and do not roll over; credits from a one-time credit pack also do not roll over.

You can cancel your subscription yourself from the Billing page. Cancelling stops future renewal; you keep access through the period you have already paid for, with no immediate downgrade and no automatic refund or credit reversal. Plans cannot be switched in place. See our Cancellation Policy and Refund Policy for details. Refund requests are reviewed manually (Paddle processes refunds as Merchant of Record), and applicable law and Paddle's terms take precedence. Questions about billing: support@brain-wise.com.

Paddle, as Merchant of Record, issues the invoice or receipt for your payment, and handles sales tax on it. Billing, transaction, accounting, tax, and related business records may be retained for as long as required by applicable law and legitimate accounting/business purposes, subject to our Privacy Policy.

8. Suspension and termination

Mitra may suspend or terminate accounts involved in fraud, abuse, security violations, or non-payment. You may stop using the Service at any time. You can request account deletion yourself from the Billing page, which deletes your login and archives your businesses; some records (such as billing/transaction history) may be retained where required for legal, tax, or fraud-prevention purposes — see our Privacy Policy, section 6, for exactly what is and isn't deleted.

9. Disclaimers and liability

The Service, including AI-generated content and Truth Check results, is provided on an "as available" basis without guarantees of accuracy, fitness for a particular purpose, or uninterrupted availability. Mitra does not guarantee marketing outcomes, legal compliance of generated content, or that generated content is free of factual errors or third-party rights issues.

10. Governing law and disputes

These Terms are governed by the laws of India. Disputes may be brought before the courts having jurisdiction in Hyderabad, Telangana, India.
